Life Ballooning Terms and Conditions of Booking

On receipt of payment a contract has been entered into between you, the passenger/s and Life Ballooning.

  1. Life Ballooning warrants that it is insured in accordance with Regulation 5 of the Domestic Air Service Regulations.
  2. Life Ballooning, nor any of their officers, agents, employees, organizers and assistants shall not, in any circumstance whatsoever, be liable for any loss or damage of property, and/or injury to any person, or death of any person from any cause whatsoever and, without in any way limiting or affecting the generality of the aforegoing, whether or not such a loss, damage, injury or death is occasioned by the fault or negligence of the operator, any of the officers, agents, employees, organizers and assistants and/or occurred while the balloon was being tethered, being filled, taking off, landing, or in flight, whilst undergoing inspection or retrieving.
  3. The passenger/s hereby indemnify the operator, their officers, agents, employees, organizers and assistants, against any claim of whatsoever nature which may be made against the operator, their officers, agents, employees, organizers, and assistants, by the passenger/s and/or any person whomsoever for any loss of or damage to property, or any injury sustained by any person or death of any person, notwithstanding that such loss of or damage to property, or injury to person or death of any person may have been occasioned by the fault or negligence of the operator, and/or any of the parties referred to above.
  4. The operator indemnifies the passenger against any damage which the operator and its servants or agents may suffer through the any act or omission of the passenger howsoever caused.
  5. This contract is valid only for the date specified therein, unless as may be mutually agreed upon by the respective parties.
  6. The operator undertakes to use their best efforts to carry the passenger and its baggage with reasonable dispatch.
  7. The operator reserves the right to refuse carriage to any person who has acquired a ticket in violation of the operator’s tariffs, rules and regulations.
  8. The conditions of carriage may not be altered, modified or amended or any provision be waived by any servant, agent or representative of the operator.

General Terms and Conditions

  1. You must be at least 18 years of age and have legal capacity to buy vouchers or tickets from us.
  2. Children under the age of 16 years must be accompanied by an adult.
  3. Passengers must be able to climb in and out of the basket unassisted.
  4. You must satisfy yourself that you are fit to fly. If you are suffering from any illness or medical condition or disability which might be affected by your participation you must take the necessary medical advice for this purpose.
  5. You must not be under the influence of alcohol or illegal drugs while participating in your flight. If your pilot is under the reasonable opinion that you are under the influence, you will not be permitted to fly. You will forfeit your ticket, and not be eligible to reschedule your flight. No refunds will be issued.
  6. Children must be at least 10 years old or 1.2m tall to fly with us.
  7. Pregnant women may not fly.
  8. We are restricted to the number of passengers per basket and total weight of passengers. We regret no passengers over 130kg without prior approval and Life Ballooning reserves the right to charge an additional fee should the booking be accepted.
  9. Any changes to bookings after e-tickets have been issued attract a 10% administration fee of total voucher value.
  10. All reschedules, cancellations or changes to bookings must be made in writing at least 48 hours before the flight.
  11. We regret no multiple flight dates will be booked.
  12. All paperwork must be submitted within 48 hours of receiving your booking reference number or your reservation will be deleted from the system.
  13. Life Ballooning reserves the right to launch from an alternate venue if necessary.
  14. Life Ballooning reserves the right to fill baskets at their discretion.
  15. Passengers are required to sign an indemnity form prior to the flight.
  16. Passengers are required to declare any pre-existing medical conditions when making a booking.
  17. Bookings are confirmed and e-tickets are only issued once payment has been received in full, terms and conditions of booking accepted and completed booking form submitted.
  18. We do not accept any cash payments on the launch site. All payments are to be made by EFT, credit card, debit card, or bank deposit.
  19. An invoice or proforma invoice will be mailed upon request.
  20. Flights are strictly weather dependent, and flights will go ahead at the sole discretion of the pilot. The pilots decision is final. If the weather does not allow us to fly passengers will be rescheduled for the next mutually convenient date. No refunds will be issued.
  21. Bookings are subject to availability, and by prior reservation only.
  22. Flights are subject to a minimum of 6 passengers per basket. If a flight cannot take place due to us not reaching our minimum take off mass, passengers will be rescheduled. No refunds will be issued.
  23. All vouchers and tickets are non-refundable.
  24. Vouchers and tickets are valid for 12 months from date of purchase.
  25. Passengers that do not arrive on the morning or are late, are liable for the full amount of the flight. Their ticket will be forfeited and a new ticket will need to be purchased in order to reschedule.
  26. Bookings office hours are Monday to Friday 09h00 to 17h00, excluding public holidays.
  27. A set breakfast with one coffee / tea / juice before and after breakfast is only valid for weekend bookings.
  28. Please call the flight line after 8pm the evening before your flight to listen to the pre-recorded flight message.
  29. Flight packages include only those services stipulated, ie. pre-flight beverages, safety briefing from the pilot, flight time of approximately 1 hour depending on weather conditions or any other factors which impact the safety of the flight, traditional toast on landing, breakfast when applicable, and your flight certificate.
  30. Life Ballooning is not responsible for any transfers by road or by air, or accommodation booked by the passenger to attend their hot air balloon flight.
  31. We will not be in breach of contract or be liable to you for any delay in performing or any failure to perform any of our obligations if it is caused by any circumstances or event beyond our reasonable control, including for example, any strike, unsuitable weather, or failure of any equipment.
  32. You have the right to cancel this contract at any time up to the fourteenth day after receiving your e-tickets, provided it is also more than 48 hours prior to your first booking.
  33. On receipt of written cancellation of this contract by yourself, we will credit your bank account as soon as possible, but within 30 days of the receipt of the notice of cancellation, subject to point 32.

By the submission of my booking form, I acknowledge that I have read and understood the terms and conditions of booking. I am aware of hot air ballooning and its associated risks, and I undertake this flight of my own free will.
